KW Command Agent Website Service Agreement
This Agreement (“Agreement”) is made and entered into as of the date of acceptance by the client (“Agent”) and Beth Sutton Real Estate Marketing (“Service Provider”) for the purpose of granting permission to the Service Provider to access and modify the Agent’s KW Command website as part of the purchased service.
AUTHORIZATION & SCOPE OF WORK
The Agent hereby authorizes Beth Sutton Real Estate Marketing to access their KW Command account for the purpose of making the specified changes, updates, and/or additions as outlined in the purchased service. These services may include, but are not limited to:
- Updating website content and images
- Adding or modifying listing information
- Adjusting branding elements (logo, agent photo, contact details)
- Performing basic troubleshooting and maintenance
The Agent acknowledges that all services performed will adhere strictly to the specifications detailed in the service description on Beth Sutton Real Estate Marketing’s website or as agreed upon directly with the Service Provider.
UNDERSTANDING OF KW CORPORATE UPDATES
The Agent acknowledges that KW’s corporate office periodically updates all agent websites, which may impact or override customizations made by the Service Provider.
- In most cases, customizations can be easily restored using the settings saved within the Agent’s website back end.
- The Service Provider is not responsible for any permanent loss of customizations due to KW Corporate updates or changes made by KW that restrict or alter website customization options.
LIMITATION OF LIABILITY
The Agent agrees that Beth Sutton Real Estate Marketing shall not be held liable for:
- Any unexpected changes made by KW Corporate that affect the functionality or appearance of the Agent’s website unless the Agent has a current Monthly Maintenance Package.
- Any technical errors, system downtime, or malfunctions within the KW Command platform.
- Any loss of data, business, or revenue resulting from website changes made at the Agent’s request.
- Any misrepresentation or errors in listing information provided by the Agent.
The Service Provider will exercise reasonable care in making updates; however, the Agent assumes all risks associated with the use and modification of their KW Command website.
INDEMNIFICATION
The Agent agrees to indemnify, defend, and hold harmless Beth Sutton Real Estate Marketing from any claims, liabilities, damages, losses, or legal fees arising out of:
- Any third-party claims related to website content, listings, or branding materials.
- Any website modifications made at the Agent’s request that result in unforeseen errors or conflicts.
- Any disputes arising from changes made by KW Corporate that affect the Agent’s website.
PAYMENT & SERVICE TERMS
- Payment for services must be made in full before any website updates are performed.
- The Service Provider is not responsible for ongoing website maintenance unless a Monthly Maintenance Package is purchased.
- Any additional updates or changes beyond the purchased service may be subject to additional fees.
TERMINATION
This Agreement remains in effect until the requested services are completed. The Service Provider reserves the right to terminate this Agreement and access to services if the Agent fails to comply with the terms outlined above.
ACCEPTANCE OF TERMS
By purchasing website services from Beth Sutton Real Estate Marketing, the Agent acknowledges that they have read, understood, and agreed to the terms outlined in this Agreement.
